Official Rules

1. Dates/Eligibility. The "The City of Carmel-by-the-Sea’s Art & Film Festival Sweepstakes" (the "Giveaway") begins August 1 2010 and ends at one minute before midnight on September 12, 2010.  The City of Carmel by-the-Sea (the "Marketing Group") may change the dates and/or terms of the Giveaway without prior notice. The “Giveaway” is open to legal residents of California, 21 years of age and older. Employees or agents of Burghardt-Doré Advertising, Citadel Broadcasting, KGO Radio, Lark Media LLC, or any other entity associated with the “Giveaway”, as well as members of the same household of any such employee or agent, may not participate. No purchase necessary. A purchase will not improve chances of winning and is not necessary to participate and/or win.

2. How to Enter. Participants may enter the “Giveaway” by completing and submitting the official “survey” entry form located on various Web sites and eNewsletters. No mechanically reproduced or photocopied entry forms will be accepted. All entries must be received through the survey on or before one minute before midnight on September 12, 2010. 

3. Selection of Winners. A random drawing will be held on September 13 2010 for three winners: Grand Prize, Second Prize, Third Prize. Winners will be drawn at random from all entries received. Winners for all prizes will be notified by phone and/or email by the “Marketing Group”. All prizes must be claimed within 7 days of the date won or will be forfeited.  Chance of winning depends on numbers of qualified entries received.

4. Identification/Taxes.  Each winner will be required to produce identification satisfactory to the “Marketing Group”.  Each winner will be asked to provide proof of age, residency, social security number, and complete an affidavit of eligibility, liability and publicity release, as prepared by the “Marketing Group”, prior to receiving their prize. Each winner will be responsible for any taxes or fees that result from the receipt and/or use of their prize and may receive an IRS Form 1099-Misc where the prize value exceeds $600. The “Giveaway” is void where prohibited by law. Anyone using fraudulent means to participate and/or win the “Giveaway” will be disqualified.

5. Release.  In exchange for the right to participate in the “Giveaway”, each participant agrees to release and indemnify the “Marketing Group”, and its officers, directors, agents, parent companies, subsidiaries and employees, sponsors or any other entity affiliated with the “Giveaway” (the "released Parties"), from any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that arise out of the participant's participation in the “Giveaway”.

6. Conditions/Restrictions. The City of Carmel-by-the-Sea’s Art & Film Festival Sweepstakes prizes include 3-night accommodations on October 7, 8, and 9, 2010, departing on October 10, 2010. However, the 3rd Prize offers a 4th night on October 10, departing on October 11, 2010, if the prize winner chooses to stay a 4th night. No other dates are available and the prizes are not transferrable or combinable. All prizes are not redeemable for cash or credit. Transportation in not included. Some restrictions may apply. “Marketing Group” and sponsors are not responsible for lost or stolen entries, technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by “Marketing Group”, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant's ability to participate. “Marketing Group” reserves the right, in its sole discretion, to cancel or suspend a promotion, game or contest should a virus, bug, computer or other problem beyond the control of “Marketing Group” corrupt the administration, security or proper execution of any Internet promotion, game or contest, or the Internet portion of any promotion, game or contest. “Marketing Group”, in its sole discretion, may award prizes to entries received by alternate means. In the event that the randomly chosen winner refuses to accept the prize(s), all prizes become property of “Marketing Group”. All participants agree to be bound by these Official Contest rules.  Odds of winning are dependent on the number of eligible entries received.

7. Retail value of prizes: Grand Prize=$4,200. 2nd Prize=$2,500. 3rd Prize=$2,000.

8. Rules. Any violation of these rules will result in disqualification.
